“Biden Signs TikTok Ban into Law: What Comes Next?”

President Joe Biden has signed a bill that poses a significant threat to TikTok’s operations in the United States, potentially leading to a nationwide ban of the popular social media platform. This legislation, included in a broader foreign aid package aimed at supporting Israel and Ukraine, mandates that TikTok’s Chinese parent company, ByteDance, must sell the app within 270 days or face severe consequences, including expulsion from U.S. app stores and internet hosting services.

Under the new law, TikTok’s deadline for divestiture is set for January 19, 2025, with a provision allowing for a 90-day extension if progress is made toward a sale. However, TikTok is not going down without a fight. CEO Shou Chew assured users in a TikTok video that the company would contest the law in court, emphasizing their confidence in prevailing against what they deem unconstitutional measures.

TikTok argues that the legislation would have dire consequences for its 170 million U.S. users and 7 million businesses operating on the platform. The bill’s inclusion in a foreign aid package was a strategic move by House Republicans to expedite its passage, leveraging the urgency of foreign aid priorities to advance domestic policy objectives.

For now, TikTok users can continue using the app as usual, but the looming uncertainty surrounding its future is palpable. Legal experts suggest that the bill’s potential infringement on First Amendment rights could render it vulnerable to legal challenges.

ByteDance’s ties to the Chinese government raise questions about the feasibility of divesting TikTok’s operations, particularly regarding the transfer of its algorithm, a critical component of its success. Without access to this algorithm, TikTok’s future viability comes into question, raising doubts about its ability to thrive in the absence of its defining feature.
